DMCA Policy

Brastraps respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged infringement that are reported to our Designated Agent.

A. REPORTING COPYRIGHT INFRINGEMENT

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on this site, please provide our Designated Agent with the following information:

  • Identification of the copyrighted work: A detailed description of the work you claim has been infringed.
  • Location of the material: The URL(s) on our website that contain the allegedly infringing material.
  • Contact Information: Your full name, mailing address, telephone number, and email address.
  • Statement of Good Faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • Statement of Accuracy: A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
  • Signature: An electronic or physical signature of the copyright owner or a person authorized to act on their behalf.

B. COUNTER-NOTICE PROCEDURE

If you believe your content was removed by mistake, you may submit a counter-notice. Upon receipt of a valid counter-notice, Brastraps may inform the original complainant and may reinstate the content within 10 to 14 business days, unless the rights owner notifies us that they have filed a court action seeking an order to restrain the user from engaging in infringing activity relating to the material on our platform.

Your counter-notice must include:

  • Identification of the removed material and its original location.
  • A statement under penalty of perjury of your good faith belief that the material was removed by mistake.
  • Your name, address, and phone number.
  • A statement of consent to the jurisdiction of the Federal District Court.
  • Your physical or electronic signature.
